Proposed Amendments to Development Permit Areas

The CSRD's Planning Services is undertaking a comprehensive update to the Development Permit Areas (DPAs) in the CSRD’s five Official Community Plans.

Why are changes being proposed?
The goal of the DPA update project is to create DPAs that:
• Support safe, appropriate, and responsible development
• Are easy to understand and implement
• Are consistent throughout the Regional District Electoral Areas
• Provide exemptions for minor development

The DPA standard templates being proposed are intended to provide improved consistency for how DPAs are defined, interpreted, and implemented among the five Official Community Plans (OCPs).

Guidelines and Exemptions will be fine-tuned to provide consistency for how DPAs are defined, interpreted, and implemented among the five OCPs. Development Permit Areas will be added to some OCPs where they don’t currently exist.

Official Community Plan
An OCP is a long-term strategy for land use management, development, and servicing. OCPs are created by the community in dialogue with locally elected commission and committee members and are intended to serve as a statement of the objectives and policies of the local government. The goals of an OCP are implemented through the zoning bylaw.

What are Development Permit Areas?
An OCP may designate Development Permit Areas (DPAs) for environmental protection, protection of development from hazardous conditions, and to guide the form and character of commercial, industrial or multi-family residential development. DPAs are delineated by means of either map or a written description (or both). If a property is located within a Development Permit Area, a development permit may be required and CSRD Development Services should be contacted before undertaking any construction or development. OCPs also identify exemptions from development permit requirements.

What are Development Permits?
A Development Permit (DP) establishes conditions under which residential, commercial, or industrial developments may take place. Once issued, it becomes binding on the existing and future owners of the property. Depending on the type of Development Permit, it must be issued by either the Manager of Development Services or the CSRD Board of Directors.
A Development Permit is not a Building Permit. A Building Permit must be obtained prior to any construction in areas that have building inspection service.

Does this affect my property?

View Geohazard Development Permit Area template
The objectives of Geohazard DPA are to minimize the risk to life, and to minimize the potential for damage to property and the natural environment by:
• Directing development away from hazardous areas;
• Making sure that if development occurs in hazardous areas it is safe for the use intended.

View Riparian Areas Protection Regulation Development Permit Area template
The intent of RAPR DPA is to:
• Protect streams, their riparian areas and adjacent upland areas that exert an influence on streams from residential, commercial, public and institutional, and industrial development.
• Promote the restoration and enhancement of riparian areas to support biologically diverse wildlife habitat, corridors for wildlife movement, and the natural features, functions and conditions that support fish life processes.

View Foreshore and Water Development Permit Area template
The objectives of the Foreshore and Water DPA are to:
• Establish a permitting process for the placement of docks, swimming platforms, and private mooring buoys to ensure proper use, density and siting in accordance with Lakes Zoning Bylaw No. 900.
• Ensure the siting of docks, swimming platforms, and private mooring buoys prevent or minimize negative impacts on foreshore and aquatic environments.
• Complement, Riparian Areas Protection Regulation DPA and Lakes 100 m DPA, recognizing the important and sensitive interrelationship of foreshore and water areas with adjacent upland areas.

View Lakes 100 m Development Permit Area template
The intent of Lakes 100 m DPA is to:
• Protect and mitigate against negative impacts on lakes and the Eagle River from land alteration and the installation of onsite sewerage systems.
• Ensure that drinking water supplies are not compromised by land alteration and the installation of onsite sewerage systems.
• Obtain assurance from a QP that adequate professional evaluation of the proposed development has been conducted (which includes recommendations and mitigative measures).
• Complement the Riparian Areas Protection Regulation DPA and Foreshore and Water DPA, recognizing the important and sensitive interrelationship between upland areas and aquatic ecosystems.

View Form and Character Development Permit Area template (Commercial, Industrial, Village Centre and Resort Lands).
The objectives of the Form and Character DPA are to:
• Ensure that commercial, industrial, resort, and village centre development is complimentary and well integrated; and,
• Ensure that new development has a high standard of building and site design, while incorporating the rural characteristics of the surrounding area; and,
• Ensure that new development includes landscaping and screening features that minimize any visual impacts to adjacent properties and public areas.
