BACKGROUND
On April 21, 2023, Governor Carney announced his decision to allow companion bills HB 1 and HB 2 to become law in the State of Delaware without his signature. Click here for more.
House Bill 1 legalizes possession of up to one ounce of recreational marijuana for adults 21 or over in Delaware.
House Bill 2 allows local municipalities to maintain control over where and when cannabis businesses may operate in their jurisdictions or prohibit commercial cannabis operations altogether via the enactment of local ordinances.

Approved January 17, 2024 Minutes - Planning Commision does not recommend for Town Council to approve the ordinance with the changes discussed.
1st Reading of Ordinance (TABLED)
Motion by Councilman Evans, seconded by Councilwoman Diaz-Malone to amend the draft Ordinance to reflect the following changes, and bring the ordinance back for a first reading:
* Change the hours of operation to 9am – 8pm, Monday through Friday; 10:00 a.m. to 5:00 p.m. on Saturday, and no retail operations may take place on Sundays
* Add language for distance from schools, daycares, rehabilitation homes, and churches to a minimum of 1,000 feet
