The NP&EDC’s strategy to ensure that no person is excluded from participating in, or denied benefits of, its services on a basis of race, color, and national origin, as protected by Title VI of the Civil Rights Act of 1964, 49 CFR 21.9(b)
The NP&EDC is committed to ensuring that no person is excluded from participation in, or denied benefits of its services on the basis of race, religion, color, age, ancestry, national origin, gender, handicap, or sexual orientation as protected by Title VI of the Civil Rights Act of 1964, 49 CFR 21.9(b). Anyone who believes there is an act of discrimination in a program or activity may file a complaint with the NP&EDC Title VI Coordinator. The NP&EDC Title VI Coordinator is responsible for initiating and monitoring Title VI activities, preparing reports and other responsibilities as required by 23 Code of Federal Regulations (CFR) 200 and 49 CFR 21.
The Complaint Process
The processing of discrimination complaints will follow the steps outlined below:
Step 1: Complainant submits their complaint.
Step 2: NP&EDC Title VI Coordinator issues the complainant an acknowledgment letter.
Step 3: Complaint is assigned to, and reviewed by, the Title VI Coordinator.
Step 4: Title VI Coordinator conducts interviews of complainants, witnesses, and the respondent.
Step 5: Title VI Coordinator reviews the evidence and testimonies to determine whether a violation has occurred.
Step 6: Complainant and Respondent are issued a letter of resolution or a letter of finding and offered appeal rights.
Step 7: Once the appeal period has expired, the investigation is closed.
Who can file a complaint?
ANY member of the public, along with all NP&EDC customers, applicants, contractors, or subrecipients who believe that they themselves, a third party, or a class of persons were mistreated or treated unfairly because of their race, color, or national origin (including limited English proficiency) in violation of Title VI of the Civil Rights Act of 1964, related federal and state laws and orders, or NP&EDC’s Anti‐Discrimination/Harassment Prevention (ADHP) Policy. Retaliation against a member of the public on the basis of race, color, or national origin is also prohibited under Title VI and the ADHP Policy.How do I file a complaint?
