Traffic Camera Enforcement Consultation

Introduction

Surrey County Council is seeking the views of residents, local businesses, visitors and road users on a proposal to introduce camera enforcement of the existing 7.5 tonne Heavy Goods Vehicle (HGV) weight restriction on B3003 Clockhouse Lane (Northbound) from Feltham Road.

The weight restriction is already in place and is clearly signed. However, surveys have identified a significant number of HGVs using Clockhouse Lane as a through route rather than for legitimate local access.

The proposed enforcement camera would help improve compliance with the existing restriction, reducing unnecessary HGV traffic on the route. This is expected to improve traffic flow, reduce congestion, minimise damage to the highway and surrounding infrastructure, and create a safer environment for all road users.

This consultation provides an opportunity for you to give your views before a final decision is made.

Background and Legislation

Under Part 6 of the Traffic Management Act 2004, local authorities can enforce certain moving traffic restrictions using cameras.

In 2022, the Department for Transport (DfT) designated Surrey County Council as a Civil Enforcement Area for Moving Traffic Contraventions. This gives the Council powers to use camera technology to enforce traffic restrictions and improve compliance with traffic regulations.

The purpose of these powers is to improve road safety, reduce congestion, support more reliable journey times and help keep traffic moving efficiently.

What is the Existing Weight Restriction?

The 7.5 tonne weight restriction on B3003 Clockhouse Lane prohibits HGVs with a maximum gross weight exceeding 7.5 tonnes from using the route unless they require access within the restricted area for activities such as deliveries, collections or servicing local premises.

The restriction is already enforced through traffic signs located on the approaches to Clockhouse Lane.

The proposal does not introduce any new restrictions. It is intended solely to improve compliance with the existing restriction.

How Would the Restriction Be Enforced?

If approved, an Automatic Number Plate Recognition (ANPR) camera would be installed to monitor vehicles travelling through the restriction.

Vehicle registrations recorded by the camera would be checked to identify potential contraventions. Where evidence shows that a vehicle has breached the restriction without a valid exemption, a Penalty Charge Notice (PCN) may be issued by post.

Civil Enforcement Officers may also undertake enforcement activities and compliance checks where appropriate.

Why Is Enforcement Being Proposed?

B3003 Clockhouse Lane serves as an important local route and is subject to an existing weight restriction intended to prevent unnecessary use by larger goods vehicles.

Traffic surveys carried out by Surrey County Council identified a notable number of HGVs travelling along Clockhouse Lane despite the existing weight restriction. Many of these vehicles appear to be using the route as a through route rather than accessing premises within the restricted area.

Large vehicles using Clockhouse Lane can:

• Cause congestion and delays, particularly during peak periods.
• Restrict the free flow of traffic.
• Increase wear and tear on the highway and surrounding infrastructure.
• Make it more difficult for other road users to pass safely.
• Increase noise and environmental impacts for nearby residents and businesses.
• Contribute to unnecessary vehicle emissions and engine idling in congested conditions.

By improving compliance with the existing restriction, the Council aims to reduce unnecessary HGV traffic and improve conditions for all road users and the local community.

What Would This Mean for Drivers?

Drivers who comply with the existing 7.5 tonne weight restriction will not be affected.

Vehicles that are permitted to use the restriction for access purposes will continue to be able to do so in accordance with the current Traffic Regulation Order. They will be required to inform the council of access so their vehicle can be added to an exemption list for the period access is required.

In accordance with Department for Transport guidance, Surrey County Council intends to operate an initial education period following implementation. During this period, warning notices may be issued instead of Penalty Charge Notices to first-time offenders.

Following the education period, a Penalty Charge Notice of £70 (reduced to £35 if paid within the discount period) may be issued for contraventions.
