City Plan Partial Review

What is Regulation 19?

The Regulation 19 process allows the public and key stakeholders to make comments on the proposed changes to the City Plan, with a view of ensuring that the changed and new policies legally compliant, sound and has been prepared in accordance with the Duty to Cooperate.

Following Regulation 19, council will review and consider all provided comments. The revised City Plan, along with representations made, will be submitted to the Secretary of State for public examination by a Planning Inspector. Due to the process of having an Independent Examination, representations cannot be treated as confidential and will be published on our website. If the Inspector finds that the proposed changes to the City Plan are legally compliant, sound and have been prepared in accordance with the Duty to Cooperate, the existing City Plan will be amended and adopted by the council for use in planning decisions.

Regulation 19 is just one of the many milestones reached and to be undertaken as part of the review of the City Plan. These milestones can be explored further in the timeline.

How to respond

The council is consulting on three policy areas only:

  • New Policy 13 Affordable housing (pages 83 - 84 of the revised City Plan)
  • New Policy 43 Retrofit First (pages 174 - 178 of the revised City Plan)
  • New Policies 8-11 Site Allocations (pages 54 - 70 of the revised City Plan)

On the homepage beneath the heading NEW AND REVISED POLICIES are three tiles, one for each policy area.

To access survey questions concerning one of the policy areas and make representations, click on the relevant tile.

If preferred, representations can also be made via email to planningpolicy@westminster.gov.uk

On the next page, you will see the policies have been separated into their policy sections, e.g. the Affordable Housing Policy contains a section on the Affordable Housing Tenure mix and on Affordable Housing contributions from small-scale residential developments.

There is a brief introduction of the different sections of the policy and below this is a list of questions to be answered.

The questions are the same for all of the policies. They ask you to confirm if you consider the policy section complies with the duty to co-operate, is sound and is legally complaint – these are the three tests that policy needs to pass in order to be adopted into the City Plan.
